1. Introduction and Definitions:

Welcome to BookMyAdventure! The following Terms of Service (“Terms”) constitute a legally binding agreement between the “user” and “BookMyAdventure”, concerning your access to and use of the “Platform”.

Definitions:

• “You”, "User" or "Adventure Seeker": refers to any individual or group who accesses the Platform to search for or book a Vendor Experience.
• "Platform": refers to the BookMyAdventure website (bookmyadventure.co.in), iOS/Android mobile applications, and any associated digital infrastructure provided and authorised by the Company to act on its behalf.
• "Vendor Experiences": refers to all travel, adventure, sports, water, air, trekking, recreational, and event-based activities hosted, managed, and executed physically by the Vendor and listed on the Platform.
• "Vendor" or "Adventure Giver": refers to the independent third-party service provider, operator, or host listing and executing the Vendor Experiences.
• "Company", "we", "us", or "our": refers to Vayam Adventures Private Limited.

By accessing or using our Platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree with all of these Terms including the policies mentioned on this page, we respectfully ask that you shall not use our Platform for now; do visit us again in the future if our terms change and better align with your preferences. BookMyAdventure collects and processes personal data (such as identity, contact, and payment information) strictly to facilitate bookings, ensure safety, and improve platform services. Users retain the statutory right to access, correct, or request the deletion of their personal data. Comprehensive details regarding data retention, data processing mechanisms, third-party sharing, and platform security protocols are governed exclusively by our standalone Privacy Policy and Cancellation & Refund Policy.

2. Nature of Our Services

• The Marketplace Platform: BookMyAdventure is a digital marketplace platform that acts purely as an intermediary connecting independent third-party service providers, operators, and hosts (“Adventure Givers” or “Vendors”) with individuals or groups (“Adventure Seekers”) looking to book adventure, travel, sports, water, air, trekking activities and other experiences/events listed on our platform and hosted exclusively by the vendors (collectively ‘Vendor Experiences’)
• The Intermediary Role: We do not own, operate, manage, control, or provide the actual adventure activities, transport, guiding services, or accommodations (collectively Vendor Experiences) etc. listed on the Platform. Our services are limited to hosting listings, facilitating search queries, providing user interface tools, and processing platform bookings. Since BookMyAdventure acts only as an intermediary booking partner, it shall not have any liability whatsoever for any aspect of the arrangements between the service provider and the user as regards the standards of services provided by the vendors.
• We act as a party for the limited and exhaustive purpose of providing a digital interface to host vendor listings, processing platform bookings, and acting as a payment collection facilitator for the Vendor. We are strictly not a party to the actual on-ground execution or delivery of the Vendor Experiences.

3. Eligibility & Account Registration

• Age Requirements: To register an account or execute a transaction on the Platform you must be at least 18 years of age and capable of entering into legally binding contracts under the Indian Contract Act, 1872.
• Registration of the User on the Platform is optional. If the User opts to register, upon completion of the registration process, the User shall receive a user ID and password. The User agrees and undertakes at all times to be responsible for maintaining the confidentiality of the password and user ID, and shall be fully responsible for all acts that occur by use of such password or user ID. Further, the User agrees not to use any other party's user ID and password for any purpose whatsoever without proper authorization from the platform.
• The User agrees to provide true, accurate, and complete information about themselves and prompt updates to keep it current. If the User provides any information that is untrue, inaccurate, or incomplete, BookMyAdventure has the right to suspend or terminate the User's registration.
• Minor Participants & Legal Guardian Consent: Minors (under 18 years of age) are strictly prohibited from booking Vendor Experiences independently. If a Vendor Experience includes minor participant(s), the booking must be executed by the minor’s parent or court-appointed legal guardian. By proceeding with a booking containing a minor, you explicitly declare that you are the lawful Court appointed guardian or parent, and you assume full physical, legal, and financial responsibility on their behalf. You agree that the Vendor may demand verification of your government-issued ID and guardianship status at the venue, and failure to provide this will result in cancellation without refund.

4. Bookings, Payments, and Digital Synchronization

• Once a payment is successfully processed through our designated third-party payment gateways, the booking details will automatically synchronize and be displayed within your secure booking dashboard on the Platform, we may also send you a message confirmation through any digital mode.
• While we instruct all Vendors to keep their availability, parameters, and pricing strictly accurate, prices and inventory are uploaded directly by the Vendors on the platform and are therefore subject to change. Although BookMyAdventure makes reasonable commercial efforts to ensure that the description and content on each page of the Platform is correct, it does not take responsibility for changes that occurred due to human or data entry errors.
• Prices displayed on the Platform are merely an 'invitation to treat' and do not constitute a legally binding offer. If the amount you pay for a ticket is incorrect due to a typographical error, vendor error, or a transactional malfunction of this website, BookMyAdventure and the Vendor reserve the right to cancel that ticket and refund the amount paid.
• Cancellations and Refunds: All financial settlements, cancellation windows, and structural refunds are governed by our separate Cancellation & Refund Policy, which works in tandem with the specific timeline parameters designated by the individual Vendor at the time of booking. Platform-side failures—including payment errors, double billing, and booking synchronization issues—are also governed under the Cancellation & Refund Policy.

• The matrix above provides a standard platform summary of cancellation timelines and penalties. However, because BookMyAdventure is an intermediary marketplace, individual Vendors retain the absolute right to enforce stricter, vendor-specific cancellation windows or non-refundable parameters, which are prominently displayed in the refund policy, and this summary table remains subject to the comprehensive terms detailed therein

5. Comprehensive Disclaimer of Liability & Assumption of Risk

• You explicitly acknowledge that the Vendor Experiences listed on the Platform (including but not limited to trekking, water sports, and aerial activities) carry inherent physical risks, which may result in severe bodily injury, emotional distress, property damage, or fatality. You voluntarily assume all such risks upon booking.
• The execution, safety protocols, equipment maintenance, emergency response, and regulatory/licensing compliance of the Vendor Experiences are the absolute and exclusive domain of the respective Vendor. BookMyAdventure is strictly a digital intermediary and shall not be held liable for any negligence, lack of safety protocols, or operational deviations by the Vendor.
• BookMyAdventure acts solely as a booking intermediary and does not provide on-ground services. Subject to applicable law and without limiting any non-waivable statutory consumer rights, BookMyAdventure’s liability for platform-only failures (such as payment processing errors or booking synchronization failures) shall be limited to a refund of the transaction amount actually received by BookMyAdventure in its account by the specific booking amount in dispute. Nothing in these Terms shall exclude or limit liability for BookMyAdventure’s gross negligence or any liability that cannot be excluded under applicable consumer protection laws in India.
• If a user is forced to abandon a Vendor Experience due to the Vendor's blatant failure to maintain safety protocols, regulatory compliance, or equipment standards, the fault lies entirely with the Vendor. While BookMyAdventure may facilitate a refund dispute on behalf of the user, the financial liability for such refunds, chargebacks, or compensation rests exclusively with the Vendor. BookMyAdventure reserves the right to withhold, deduct, or claw back these amounts directly from the Vendor's ledger. BookMyAdventure shall not bear out-of-pocket expenses for Vendor defaults.
• The maximum liability on the part of BookMyAdventure arising under any circumstances, in respect of any services offered on the BookMyAdventure’s website, IOS/ Android Application(s) shall be limited to the refund of the total amount received from the user for availing the limited booking services as provided by BookMyAdventure, less any cancellation, refund or other charges, as may be applicable at the time of booking for Vendor Experiences.
• Furthermore, as an intermediary, BookMyAdventure expressly disclaims liability for the following: (a) the Vendor's staff acting unprofessionally or rudely; (b) the delayed start or itinerary changes of an activity; (c) the loss, theft, or damage of a User's personal baggage, electronics, or vehicles at the venue; and (d) the Vendor changing the specific boarding or starting point of the experience. Though, if anyone reports any such problem to BookMyAdventure, efforts (communication) may be made on your behalf to the Vendor.
• BookMyAdventure and other listed independent Vendors shall not be liable for any failure or delay in performance of obligations arising from causes beyond their reasonable control, including but not limited to acts of government, pandemic, epidemic, national lockdown, civil unrest, natural disaster, flood, earthquake, terrorism, internet or power infrastructure failure, or any order or regulation imposed by a competent authority. In such events, BookMyAdventure will endeavour to notify affected users within 48 hours and process applicable refunds in accordance with the Cancellation & Refund Policy.

6. Intellectual Property & Proprietary Rights

• Our Proprietary & IP Assets: The digital assets, including but not limited to the proprietary software, source code, user interfaces, visual design systems, databases, and the registered trademark BookMyAdventure®, are the exclusive property of Vayam Adventures Private Limited.
• Third-Party Content: BookMyAdventure may provide the User with content such as photographs, graphics, or video contained in sponsor advertisements or information. This material may be protected by copyrights, trademarks, or other intellectual property rights. The User may use this material only and if expressly authorized by BookMyAdventure in written terms. The User agrees that they shall not upload, post, reproduce or distribute any content on the Platform that is protected by copyright of a third party without obtaining express written permission.
• Limited License (Non-Commercial Use): The User agrees and undertakes not to sell, trade, resell or exploit for any commercial purposes, any portion of the service provided or advertised by BookMyAdventure or its authorised partners without express written consent. The Website/ IOS/ Android Application(s) is specifically meant for personal use only. The User further agrees and undertakes not to reverse engineer, modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products or services obtained from the Website/ IOS/Android Application(s).

7. Conduct & Platform Rules

As a condition of the use of the Platform, any person including the User agrees and understands that they will not use the Platform for any purpose that is unlawful or illegal under any law for the time being in force within or outside India or prohibited by these Terms. Prohibited actions include, but are not limited to:

• Falsifying your location data or personal identity during bookings.
• Interfering with the automated payment ledger or manipulating checkout flows.
• Uploading malicious payloads, virus scripts, or utilizing automated scrapers to extract pricing data.
• Attempting to circumvent the Platform's payment systems, fee structure, or booking processes by finalizing transactions directly with a Vendor initially discovered through our Platform.
• Using the Platform in any manner which could damage, disable, overburden or impair it or interfere with any other party's use and/or enjoyment of the Platform.

8. Statutory Safe Harbor

The platform BookMyAdventure qualifies as an "Intermediary" under Section 79 of the Information Technology Act, 2000. We do not exercise prior editorial control over user-generated reviews or third-party including vendor inventory listings.

9. Indemnification

The User agrees to indemnify, defend, and hold harmless Vayam Adventures Private Limited, its directors, employees, and affiliates from and against any and all losses, liabilities, claims, damages, or costs (including advocate fees) arising out of: (a) physical injury, death, or property damage suffered during a Vendor Experience; (b) any breach of these Terms, including false declarations of legal guardianship; and (c) violation of any local laws or third-party rights.

10. Mandatory Arbitration & Governing Law

• Governing Law: These Terms, their interpretation, and any legal relationship established by them shall be governed by and construed in accordance with the laws of India.
• Amicable Resolution: In the event of any dispute, misunderstanding, or grievance arising out of your platform use, parties will first attempt to resolve the issue through mutual consultation in good faith within 30 days.
• Arbitration Clause: If an amicable resolution cannot be reached, the dispute shall be referred to and finally resolved by binding sole arbitration under the provisions of the Arbitration and Conciliation Act, 1996 (as amended). The seat and venue of the arbitration shall be Udaipur, Rajasthan, India. The language of the arbitration proceedings shall be English.
• Exclusive Jurisdiction: Subject to the arbitration clause above, any legal filings or residual judicial interventions shall be subject to the exclusive jurisdiction of the competent Courts located in Udaipur, Rajasthan, India.

11. Modifications & Termination

BookMyAdventure reserves the right to change the terms, conditions and notices under which the Booking services are offered through the Website/ IOS/Android application(s), including but not limited to the pricing for the Vendor Experiences. The User shall be responsible for regularly reviewing these terms and conditions. We will indicate the revision date at the top of this document. Continued usage of our platform post-update signifies clear and unconditional acceptance. We reserve the absolute right to suspend accounts that compromise platform security or violate user conduct clauses without prior notice.

12. Miscellaneous

• Severability: If any provision of this Agreement is declared to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect. Furthermore, it should be modified to the minimum extent necessary to make it enforceable while maintaining the parties' original commercial intent.
• Headings: The headings and subheadings herein are included for convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of this Agreement, the Terms or the right to use the Website or IOS/Android application(s) by the User contained herein.

Note – To differentiate between routine feedbacks/ dislikes and an actual grievance the user’s email’s subject must read “Invoking - Dispute Resolution & Grievance Officer Section of the terms document”. The Grievance Officer will acknowledge the receipt of any consumer grievance within forty-eight business hours and shall endeavour to provide a reasonable resolution or final status update within one month from the date of receipt.
