Welcome to BookMyAdventure! This Privacy Policy constitutes a valid, legally binding electronic agreement between any person accessing the Platform, including you, whether personally or on behalf of an entity ("you", "User", "Adventure Seeker", or "Vendor"), and Vayam Adventures Private Limited ("we", "us", "our", or "Company"). By accessing or using our Platform, you acknowledge that you have read, understood, and agreed to be bound by this Privacy Policy.

Definitions

• "Platform": refers to the BookMyAdventure website (bookmyadventure.co.in), iOS/Android mobile applications, and any associated digital infrastructure provided by the Company.
• "Vendor Experiences": refers to all travel, adventure, sports, water, air, trekking, recreational, and event-based activities hosted, managed, and executed physically by the Vendor and listed on the Platform.
• "User" or "Adventure Seeker": refers to any individual or group who books a Vendor Experience through the Platform.
• "Vendor" or "Adventure Giver": refers to the independent third-party service provider hosting or listing a Vendor Experience.
• “Data”: includes information that you submit to us directly, and information which is accessed or collected automatically pursuant to your visit to the Platform.

2. Data and Information Collection: We receive Data both directly as well as indirectly/passively from your use of the Platform.

• A. Data Shared Directly by You (for example: Name, contact number, age etc.)
• B. Data Collected Automatically (Indirectly) (for example: IP address, type of browser, vendor experiences visited etc.)

3. Cookies, Pixels, and Tracking Technologies

Information may be automatically collected through the use of Cookies, web beacons, or other technologies.

• Cookies: "Cookies" are text files placed in your device's browser that store basic information our Platform can use to recognize repeated visits and recollect your preferences. We use this to understand your usage, observe behaviour, and compile aggregate data to improve your experience like offering BMA vouchers, offering discounts etc. Cookies do not attach to your system or damage your files. You may change the permission in your browser to deny or accept Cookies; however, personalized services and booking synchronization may get affected if the cookie option is disabled.
• Web Beacons & Analytics: We and our partners may use "web beacons" or third-party web analytics (such as Google Analytics) to monitor behaviour. To prevent Google Analytics from collecting or using your information, you may install the Google Analytics Opt-Out Browser add-on.

4. Purpose & Use of Information:

We may use the Data we collect for legitimate business purposes (including but not limited to: executing and enforcing our B2C Terms of Service, Master Vendor Agreement, and Cancellation & Refund Policy; processing bookings and platform synchronization; and providing technical support)

5. Data Sharing and Disclosure:

Generally, we do not sell or rent personal information about our users or vendors to any third parties. We may share or disclose your data in the following specific manners:

• Vendors and service providers: We are a digital marketplace intermediary. We share necessary booking information (such as names and contact details) with the specific Vendor hosting your selected Adventure Vendor Experience strictly for the completion of the transaction and on-ground execution.
• Payment & Tech Partners: We employ other companies to perform functions on our behalf, such as processing payments, providing marketing assistance, and transmitting content.
• Compliance with Laws: We may release Data when we believe disclosure is reasonably necessary to (a) comply with a law, regulation, or legal request; (b) protect the intellectual property rights of the Company; (c) protect the Company from damages or claims; or (d) investigate suspected fraudulent or illegal activity.
• Business Transfers: If our company undergoes a corporate restructuring, merger, or acquisition, your Data may be securely transferred to the succeeding entity strictly for the purpose of continuing to provide the Platform's services to you.

6. Data Storage and Security:

We have implemented security measures to protect against the loss, misuse, and alteration of the information under our control. We protect the secure areas of our site with a firewall and maintain physical, electronic, and administrative safeguards. While we strive to safeguard your data, your personal data comes to us via the internet, and no method of transmission is completely secure. We cannot give an absolute warranty that the means whereby information is conveyed are completely safe.

We retain Data for as long as necessary to provide access to our Platform, fulfil the purposes outlined in this policy, or for other essential purposes such as complying with legal obligations, resolving disputes, and enforcing our agreements.

8. Your Privacy Rights & Opt-Out

• You have the right to access, correct, or update your personal information by contacting us or editing your dashboard.
• We allow users the option to opt-out of receiving promotional communications from us. If you decide later to opt-out, you can do so by contacting our administrative email or using the opt-out links provided in our emails.

Note: To differentiate between routine feedback and an actual statutory privacy grievance, the user's email subject must read: "Invoking Dispute Resolution & Grievance Officer Section of the Privacy Policy." The Grievance Officer will acknowledge the receipt of any consumer grievance within forty-eight (48) business hours and shall endeavour to provide a reasonable resolution or final status update within one (1) month from the date of receipt.

10. Mandatory Arbitration & Governing Law

• Governing Law: This Privacy Policy, its interpretation, and any legal relationship established by it shall be governed by and construed in accordance with the laws of India.
• Amicable Resolution: In the event of any dispute, misunderstanding, or grievance arising out of your platform use, parties will first attempt to resolve the issue through mutual consultation in good faith within 30 days.
• Arbitration Clause: If an amicable resolution cannot be reached, the dispute shall be referred to and finally resolved by binding sole arbitration under the provisions of the Arbitration and Conciliation Act, 1996 (as amended). The seat and venue of the arbitration shall be Udaipur, Rajasthan, India. The language of the arbitration proceedings shall be English.
• Exclusive Jurisdiction: Subject to the arbitration clause above, any legal filings or residual judicial interventions shall be subject to the exclusive jurisdiction of the competent Courts located in Udaipur, Rajasthan, India.

11. Modifications & Termination

We reserve the right to change this Privacy Policy as we may deem necessary, from time to time or as may be required under applicable law. You shall be responsible for regularly reviewing this privacy policy. We will indicate the revision date at the top of this document. Continued usage of our platform post-update signifies clear and unconditional acceptance.

12. Miscellaneous:

• Severability: If any provision of this Privacy Policy is declared to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Privacy Policy shall continue to be in full force and effect.
• Headings: The headings and subheadings herein are included for convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of this Privacy Policy.
