1. Introduction & Definitions
Welcome to BookMyAdventure! This Cancellation & Refund Policy ("Policy") governs the financial settlements, cancellation windows, and refund processes for all bookings made through the BookMyAdventure website and mobile applications. This document serves as the explicitly referenced "separate Cancellation & Refund Policy" mentioned in both our B2C Terms of Service and B2B Master Vendor Agreement. By accessing the Platform, booking an experience, or listing an experience, you unconditionally agree to this Policy.
Definitions
- “Platform”: refers to the BookMyAdventure website (bookmyadventure.co.in), iOS/Android mobile applications, and any associated digital infrastructure provided by BMA.
- ”Vendor Experiences”: refers to all travel, adventure, sports, water, air, trekking, recreational, and event-based activities hosted, managed, and executed physically by the Vendor and listed on the Platform.
- "Vendor" refers to the independent third-party service provider hosting the Vendor Experience.
- “User”: refers to any individual or group who books a Vendor Experience through the Platform.
2. The Marketplace Booking Model
BookMyAdventure is purely a digital intermediary. The specific Vendor Experiences are executed entirely by independent Vendors.
- Because each adventure has different logistical costs, each Vendor sets their own specific cancellation timeline and penalty parameters, which are displayed on the checkout page at the time of booking.
- In the absence of a specific Vendor timeline, the standard platform cancellation rules detailed in the following Sections shall apply.
3. User-Initiated Cancellations
If a User wishes to cancel a booking, they must do so via their secure BookMyAdventure dashboard.
- Unless the Vendor’s specific listing states otherwise, cancellations made 7 days before the scheduled activity will be eligible for a refund, minus a nominal payment gateway processing fee.
- Cancellations made within 48 hours – 7 days of the scheduled activity shall be subject to a 50% cancellation fee. Cancellations made less than 48 hours before the activity are strictly non-refundable.
- Failure to arrive at the designated venue on time constitutes a "No-Show" and is strictly non-refundable.
- Users must present original government-issued IDs at the venue. If a booking includes a minor (under 18) and the accompanying adult fails to prove they are the authorized Legal Guardian, the Vendor will deny entry. This is treated as a breach of contract by the User and is strictly non-refundable.
4. Vendor-Initiated Cancellations & Defaults
- BookMyAdventure and other listed independent Vendors shall not be liable for any failure or delay in performance of obligations arising from causes beyond their reasonable control, including but not limited to acts of government, pandemic, epidemic, national lockdown, civil unrest, natural disaster, flood, earthquake, terrorism, internet or power infrastructure failure, or any order or regulation imposed by a competent authority. In such events, BookMyAdventure will endeavour to notify affected users within 48 hours and process applicable refunds in accordance with the Refund Policy. If a Vendor Experience is cancelled by the Vendor due to unsafe weather conditions, natural disasters, or regulatory lockdowns (Force Majeure), the User will receive a 75% refund of their booking amount. The remaining 25% is retained as a non-refundable administrative and payment processing fee.
- If the Vendor cancels the activity due to their own equipment failure, staff unavailability, or overbooking, the User is entitled to a full refund less platform and convenience fee. This refund amount shall be debited and refunded solely out of the Vendor's own pocket.
- If a User arrives at the venue and is forced to abandon the activity because the Vendor blatantly lacks the promised safety protocols, operational licenses, or legally mandated equipment, the User is entitled to a full refund. (Financial liability for operational failures and safety breaches rests exclusively with the Vendor, as per Section 6).
- If a Vendor cancels a Vendor Experience within 24 hours of the scheduled start time, or fails to honour a synchronized booking in bad faith, BookMyAdventure will immediately intervene to protect the User. Once such an issue is raised by the user and upon enquiry BMA finds out that the vendor indeed worked in bad faith, BMA will provide the User with an BMA voucher or full refund issued to their source account. All financial out-of-pocket costs, damages, and interim credits deployed by BMA to settle the User’s grievance under this fallback clause shall be debited 100% from the defaulting Vendor’s pending ledger or recovered via strict legal actions.
5. Limitation of Liability for Platform-Side Failures
BookMyAdventure’s financial liability for platform-related failures—including payment errors, double billing, and booking synchronization issues—shall be strictly limited to the exact transaction amount actually received and credited to BookMyAdventure’s bank account.
- This explicitly excludes any non-refundable convenience fees, taxes, or charges deducted by third-party payment gateways. BookMyAdventure shall not bear out-of-pocket expenses for transactional errors beyond the net amount received in its own account.
- In the event of a platform latency error resulting in an un-synchronized double billing or a bank debit without experience generation, BMA guarantees an interim review within 48 hours of time of knowledge which shall be initiated either by the experience seeker or vendor and a definitive resolution or gateway reversal initiation within 7 business days from the date of intimation by the user.
6. Vendor Financial Obligations (Right of Set-Off)
As established in the Master Vendor Agreement, BookMyAdventure does not bear the out-of-pocket costs for Vendor-side cancellations or operational defaults at the vendor experience site.
- If a refund is issued to a User under Section 4 due to the Vendor's operational failure or safety breach, BookMyAdventure reserves the absolute right to unilaterally deduct, withhold, or claw back the equivalent refund amount directly from the Vendor’s pending or future ledger payouts.
7. Refund Processing Mechanics (BMA Vouchers & Source Accounts)
To ensure a seamless user experience, BookMyAdventure processes approved refunds through a two-step mechanism:
- Approved refunds will initially be issued in the form of a BookMyAdventure digital voucher or wallet credit, which can be instantly redeemed against selected future Vendor Experience on the Platform.
- A BMA Voucher represents a closed-loop digital credit equivalent to the agreed refund amount. It is mapped exclusively to the registered account, email ID, or mobile number of the User who executed the original booking.
- Once a refund is structured and issued as a BMA Voucher, it is strictly non-encashable. It cannot be legally converted into fiat currency, nor can it be transferred back to a bank account, credit card, or UPI wallet under any circumstances.
- BMA Vouchers are tied to the original purchaser. They cannot be sold, traded, gifted, or transferred to any other third party or alternate User account.
- Upon the expiration of the defined validity period, any unused digital credit shall automatically lapse and be permanently forfeited. BookMyAdventure reserves the absolute right to deny any requests for validity extensions, reactivation, or cash equivalents for expired BMA vouchers.
- If the User does not wish to accept the BMA digital voucher, they must explicitly request a bank refund. Upon this request, the amount will be credited exclusively back to the original payment method (Credit Card, UPI, Net Banking) used during the initial transaction within 10 days. We do not issue cash refunds or transfer funds to alternate bank accounts.
8. Vendor Conduct & Platform Rules
As a condition of using the Platform, the Vendor agrees that they will not use the Platform for any purpose that is unlawful or prohibited by these Terms. Prohibited actions include, but are not limited to:
- Attempting to circumvent the Platform's payment systems or fee structure by encouraging Users initially discovered through BMA to cancel their bookings and finalize transactions directly with the Vendor.
- Falsifying business identities, uploading fraudulent reviews, or interfering with the automated payment ledger.
- Uploading malicious payloads, virus scripts, or utilizing automated scrapers to extract BMA's proprietary pricing data or User databases.
- Using the Platform in any manner which could damage, disable, overburden, or impair it, or interfere with any other party's use of the Platform.
9. Mandatory Arbitration & Governing Law
- Governing Law: These Terms, their interpretation, and any legal relationship established by them shall be governed by and construed in accordance with the laws of India.
- Amicable Resolution: In the event of any dispute, misunderstanding, or grievance arising out of your platform use, parties will first attempt to resolve the issue through mutual consultation in good faith within 30 days.
- Arbitration Clause: If an amicable resolution cannot be reached, the dispute shall be referred to and finally resolved by binding sole arbitration under the provisions of the Arbitration and Conciliation Act, 1996 (as amended). The seat and venue of the arbitration shall be Udaipur, Rajasthan, India. The language of the arbitration proceedings shall be English.
- Exclusive Jurisdiction: Subject to the arbitration clause above, any legal filings or residual judicial interventions shall be subject to the exclusive jurisdiction of the competent Courts located in Udaipur, Rajasthan, India.
10. Modifications & Termination
BookMyAdventure reserves the right to change the terms, conditions and notices under which the Booking services are offered through the Website/ IOS/Android application(s), including but not limited to the pricing for the Vendor Experiences. The User shall be responsible for regularly reviewing these terms and conditions. We will indicate the revision date at the top of this document. Continued usage of our platform post-update signifies clear and unconditional acceptance. We reserve the absolute right to suspend accounts that compromise platform security or violate user conduct clauses without prior notice.
11. Miscellaneous
- Severability: If any provision of this Agreement is declared to be invalid or unenforceable in whole or in part, such invalidity or unenforceability shall attach only to such provision or part of such provision and the remaining part of such provision and all other provisions of this Agreement shall continue to be in full force and effect. Furthermore, it should be modified to the minimum extent necessary to make it enforceable while maintaining the parties' original commercial intent.
- Headings: The headings and subheadings herein are included for convenience and identification only and are not intended to describe, interpret, define or limit the scope, extent or intent of this Agreement.

13. Grievance Redressal:
Any disputes, escalations, or grievances arising from the execution of this Refund Policy shall be governed by the statutory Dispute Resolution & Grievance Officer Section detailed explicitly in the BookMyAdventure Terms of Service (for Users/Adventure Seekers) & the Master Vendor Agreement (for Vendors).
